Terms of service

The terms for using Swamp Dragon, its website and paid plans.

Last updated:

These terms ("Terms") are an agreement between you and Swamp Dragon ("Swamp Dragon", "we", "us") and govern your use of the Swamp Dragon desktop app (the "App"), this website, and any paid plan (together, the "Service"). By downloading, installing or using the Service, you agree to these Terms. If you use the Service for an organization, you agree on its behalf and confirm you're authorized to do so.

#1. The Service

Swamp Dragon is a screen recorder and video editor that runs on your computer. Recording, editing and exporting happen locally. Features available to you depend on your plan, as described on the Pricing page.

#2. Your license to use the App

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on computers you own or control, for your personal or internal business purposes, within the limits of your plan. You may not:

  • copy, modify, distribute, sell or sublicense the App, except as allowed by law or by open-source licenses that apply to parts of it;
  • reverse engineer or decompile the App, except where the law permits this despite this restriction;
  • remove the Free plan watermark by technical means, or circumvent plan limits or license checks;
  • use the Service to break the law or infringe anyone's rights.

The App includes third-party open-source components (for example Electron, FFmpeg and MediaPipe), which are licensed under their own terms. Those licenses take precedence for those components.

#3. Your content

You own your recordings, projects and exports. We claim no rights to them, and because they stay on your computer, we don't have access to them. You're responsible for your content and for having the rights and permissions it requires — in particular:

  • Consent to record. Recording other people's voices, video or screens may require their consent under laws that vary by place. Make sure you have it, and follow your organization's policies.
  • Third-party material. Only record and publish software, media and information you're allowed to share. Use privacy blur to hide confidential data before sharing.

#4. Accounts, plans and billing

  • Paid plans are subscriptions billed in advance monthly by Swamp Dragon, and renew automatically until cancelled.
  • Prices are shown on the Pricing page and may change. We'll give at least 30 days’ notice before a price change applies to your subscription, and you can cancel before it does.
  • You can cancel at any time; your plan stays active until the end of the paid period, then returns to Free.
  • Taxes are added where required.
  • Refunds are described in the refund policy.
  • A subscription is for one person.

#5. Plan limits

Plans include limits such as maximum recording length per clip and access to certain features. When a recording reaches your plan's limit, the App stops and saves the recording. Free plan exports include a watermark.

#6. AI assistants and MCP

The optional MCP integration lets third-party AI assistants you choose read and edit projects you share. Those assistants are provided by others under their own terms; we're not responsible for them, their output, or how their providers handle data. Review assistant edits before publishing — they're undoable in the editor.

#7. Plugins

Plugins may be provided by us or by third parties under their own terms. Third-party plugins are not our products, and we're not responsible for them.

#8. Updates and changes

We may release updates that add, change or remove features. We'll try not to remove core features from a paid plan during a paid period; if we do so materially, you may cancel and request a prorated refund for the unused period.

#9. Feedback

If you send us ideas or suggestions, we may use them without obligation to you.

#10. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee the Service will be uninterrupted or error-free, or that recordings can always be recovered after a crash. Keep backups of important recordings. Some jurisdictions don't allow these exclusions, so they may not all apply to you.

#11. Limitation of liability

To the fullest extent permitted by law, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Nothing in these Terms limits liability that can't be limited by law, including for fraud or death or personal injury caused by negligence, and consumers keep any statutory rights they have.

#12. Indemnity

If you use the Service for business, you'll defend and indemnify us against third-party claims arising from your content or your breach of these Terms.

#13. Suspension and termination

You can stop using the Service at any time. We may suspend or end your access to paid features if you materially breach these Terms, for example by circumventing plan limits or not paying. Sections 3, 9–12 and 14 survive termination. Your recordings and projects remain on your computer.

#15. Changes to these Terms

We may update these Terms. We'll post the new version here, update the date above, and for material changes notify you by email or in the App at least 30 days before they apply. If you keep using the Service after that, the new Terms apply.

#16. General

These Terms, together with the privacy policy and refund policy, are the entire agreement between you and us about the Service. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision isn't a waiver. You may not assign these Terms without our consent; we may assign them to a successor.

#Selling on the market

Swamp Dragon is the merchant of record and collects all payments for every plugin and skill at Swamp Dragon’s checkout.

  1. Sellers may not integrate or link any payment gateway, checkout, donation or payment link, or take payment outside Swamp Dragon for a market listing.
  2. The creator share is 80% of the net sale price. Net earnings are the sale price minus the platform’s share, refunds and chargebacks in that period.
  3. Payouts are calculated per calendar month and transferred at the end of every month to the payout account the seller provided. Processing completes within the first few business days after month end. The minimum payout is US$25; smaller balances roll over to the next month.
  4. Refunds and chargebacks are deducted from the next payout. Swamp Dragon may hold payouts for suspected fraud or a breach of the guidelines.
  5. Sellers must provide accurate payout and identity details and keep them up to date. Swamp Dragon is not responsible for transfers to incorrect details supplied by a seller.
  6. Swamp Dragon collects and remits sales tax or VAT where required. Sellers are responsible for their own income taxes.

Choose a supported payout method during submission. After approval we send a secure link for bank details; never send bank details by email. Payout questions: payouts@swampdragon.space.
